Stop signaling: trucks from the EAEU will be blocked from leaving Russia in case of non-payment of fines

If there are unpaid fines (for example, for overloading), foreign trucks will be blocked from leaving Russia after March 1. It is from that day that Russia will introduce a cabotage transportation system, thanks to which trucks from EAEU countries will be able to transport goods within our country. For debts Rostransnadzor will be able to detain them on the entire territory of the Russian Federation: the necessary regulations have already been adopted for this purpose, the Ministry of Transport told "Izvestia". However, so far the databases of Rostransnadzor and FCS have not been harmonized and fines either do not arrive or arrive with a delay, as the association "Gruzavtotrans" specified. And this puts foreign carriers in a more favorable position before Russian companies. Izvestia looked into how the innovation will change the market.
Why it is difficult to fine foreign carriers
From March 1, the number of foreign transport and logistics companies (TLC) engaged in domestic transportation within the country should increase significantly in Russia. From this date cabotage transportation will be launched, when trucks from EAEU countries will be able to transport goods within the country.
They will be allowed no more than three consecutive trips within seven days of the first unloading in Russia. Each trip must be confirmed by a bill of lading and represent a stage to the next loading or state border. Transportation of dangerous goods will be prohibited. If foreign TLCs violate these and other conditions, they will not be allowed to operate for one year from the date the violation was discovered, the Ministry of Transport told Izvestia.
They added that Rostransnadzor's authority to detain vehicles belonging to foreign carriers throughout Russia with unpaid fines, including for overloading, has also been established.
- In addition, regulations have been adopted that establish the authority of the Federal Customs Service to prevent foreign carriers from leaving the territory of the Russian Federation in the presence of unpaid fines," the department added.
The FCS confirmed to Izvestia that the customs authorities are authorized to control the payment of fines by foreign carriers.
This is done in order to equalize foreign TLCs from the EAEU with Russian carriers in the domestic market. They will be able to take orders within the country and work on an equal footing with domestic companies, which means that they will have to pass weight and dimensional control, pay through the "Platon" system the fare, as well as all fines, including for overloading (the maximum amount up to 600 thousand rubles). Now foreigners are not charged for overloading, but they cannot leave the country with debts for speeding, traffic violations and so on.
However, market participants have doubts about the workability of the requirements specified by the Ministry of Transport for carriers from the EAEU.
- Despite the assurances of the Ministry of Transport, difficulties with the accrual of fines for overweight are one of the main competitive advantages of foreign companies over Russian ones," Vladimir Matyagin, president of the association Gruzavtotrans, told Izvestia. - They cannot be fined at points of automatic weight and dimensional control (APVGK).
These points transmit weighing certificates online to the Center for Automated Fixation of Administrative Offenses (CAFAP) for drawing up protocols. But, as market participants note, the Russian system does not have access to foreign databases, and the owners have to search for them manually using information from the Federal Customs Service, which is too labor-intensive and not always possible, he adds.
A truck with a foreign license plate can be detained, moved to a special parking lot or restrained by blockers for non-payment of fines, Oleg Pavlov, chairman of the Public Consumer Initiative (PCI), told Izvestia. Trucks with existing debts will also not be allowed to enter Russia. Up to three hours from the moment of arrival at the checkpoint are given for repayment, the expert noted.
- The task of equipping the APVGK with an automatic function of accounting for foreign license plates was set back in 2024, - he said. - At present, it is probably at the stage of fulfillment, so that Rostransnadzor inspectors can now fix exceeding weight and dimensions with the subsequent imposition of a fine mainly only at ordinary checkpoints in person.
According to Vladimir Matyagin, from January 1, Russian truckers will be fined 375-600 thousand rubles (previously it was 250-400 thousand) automatically at APVGK. But foreigners will rarely be penalized with the personal participation of Rostransnadzor inspectors, during scheduled raids, which are not every week and not everywhere, he believes.
Foreign carriers have a huge advantage over Russian TLCs. They can potentially sabotage the requirements of the Ministry of Transportation and drive with overweight in the absence of raids by Rostransnadzor. And overweight is a significant saving for the carrier and reduction of tariffs at the same time harming the roads, emphasized the market participant.
In addition, carriers from the EAEU have other advantages - low leasing payments for equipment and access to favorable loans. Cabotage for them is a way to reduce costs, a side income in addition to the already paid international transportation, because of which they can reduce prices, taking "bread" from the Russian business, added Vladimir Matyagin.

What share of the Russian market will be taken by foreign carriers?
Domestic trucking companies are confident that the competitive advantages of foreign TLCs will help them quickly gain a foothold in the Russian market. According to AvtoGruzEx, their share will reach 10-15% in the next few years. According to Da-Trans and 100 Roads TLC, the foreign cabotage segment will account for 3-5% in 2024.
- Foreign carriers will take the market away from small and medium-sized businesses that have a minimum margin of safety," believes Roman Sudorgin, founder of the Main Transport trucking service.
According to the information of the 3PL-operator NC Logistic, foreign players can take over part of transportation of inexpensive goods, which will not have a significant impact on the major players in the logistics market, Artem Vaskanyan, deputy general director for logistics of this company, told Izvestia.
Large transportation and transportation of expensive cargoes will remain with Russian firms, given the high requirements that are imposed on the executors of such orders, he believes.
According to AvtoGruzEx, cabotage transportation will be profitable only when delivering general cargoes - large consignments for one recipient.
- The direction from China through Kazakhstan and then through the territory of the Far East region of Russia may become the most demanded," continues Vadim Filatov, President of AvtoGruzEx.
In this case, TLCs from Kazakhstan will have competitive advantages, but much depends on the terms, conditions and quality of delivery that they will offer to customers.
- Soon we can expect the emergence of a significant number of carriers, especially from Belarus and Kazakhstan, where the transportation infrastructure is well developed," Mikhail Koptev, commercial director of the federal transportation company Skif-Kargo, told Izvestia.
The expert believes that price wars between them may lead to pressure on domestic companies, which will complicate their financial performance and may lead to the withdrawal of some of them from the market.
